The current uses and the state of conservation of the sheep tracks

In Italy, Abruzzo, Molise and Puglia, but with traces also in Campania and Basilicata, the tratturi system had, at the moment of its maximum development, a consistency of about 3000 km of track (Iazzetti, 1999). Specifically in the transhumance between Abruzzo and Puglia, the tratturelli reached the width of 111.60 m, the tratturelli the width between 32 and 38 meters, hybrid between 12 and 18 meters. These were particular roads; arranged as the meridians (tratturi) and parallel ones (braccia and tratturelli), they formed a narrow-meshed road network that balanced the territory concerned (Cialdea, 2007b). On the other hand, those with a greater impact on the landscape, such as public roads, buildings and private entrances, are mainly present on the sheep track "Castel di Sangro-Lucera", while the underground crossings of pipelines and the crossings of overhead lines concern the sheep tracks "L 'Aquila-Foggia ”and“ Sant'Andrea- Biferno ”. On the “Celano-Foggia” sheep track the presence of building material deposits is significant.

The tratturi, which have always been subject to protection laws as they are intended for public use, have always been administered with a publicistic regime that is proper to state property.

They are therefore inalienable and imprescriptible, that is, in every respect they escape usucapione and prescription. Not even the cessation of their use, even if by desuetude, can affect their integrity if an act of declassification does not intervene, that is to say a passage from the list of state property to that of patrimonial assets (private property) of the State. Any different and temporary uses, never modifying the state of affairs, are accepted only with an administrative concession deed, a single, unilateral deed, which binds only the concessionaire. In more recent times, under the new Kingdom of Italy, the administration of the tratturi, also of the parts falling into the regions concerned, Abruzzi and Molise, always remained in Foggia under the Management of Reintegra dei Regi Tratturi of the Kingdom of Italy, then it passed to the Commissariat for the Reintegration of the Tratturi directly reporting to a ministerial department. And finally, due to the D.P.R. 616/77, the administrative functions inherent to the tratturi were conferred to the competent regions for the territory.
